In general, if you have assets and income above certain levels, the law expects you to repay a portion of your debts. Under Chapter 13 bankruptcy, the Court orders creditors to reduce your debts and extend payment terms. In return you agree to repay the reduced debts. Under Chapter 13, you get to keep most or all of your property.

Individuals with few assets or low income may be better off filing for Chapter 7 bankruptcy.

However, the bankruptcy laws will change in October 2005, and your option to file under Chapter 7 will be restricted. Persons considering bankruptcy should call as soon as possible.
