Individuals Wanting to Eliminate Debt Entirely

Under Chapter 7 of the bankruptcy codes, an individual or business can eliminate unsecured debt entirely through a Chapter 7 filing.

An individual filing Chapter 7 can eliminate credit card debt, revolving debt, unpaid bills, medical bills, and taxes owed, while retaining most or all of the person’s property. Filing Chapter 7 has a negative effect on your credit rating and can sometimes harm your employment prospects.

As an experienced Chapter 7 attorney, I can advise you as to your eligibility to file Chapter 7, and whether this or another bankruptcy option would be best for you.

Those individuals who have significant assets they want to protect, may be better off filing for bankruptcy under Chapter 13.

Businesses Filing Chapter 7

Typically a business which files for bankruptcy under Chapter 7 intends to cease operations. In these cases, Chapter 7 is intended to allow the orderly termination of the business’s operations and provide for a liquidation of its assets and the payment (to the extent possible), of its debts.

Sometimes a business can file for bankruptcy using Chapter 7, and the business owner can re-acquire the assets of the business.

In some situations, filing Chapter 11 bankruptcy may be the best solution for a business. Under Chapter 11, a business continues to operate while repaying its debts.
